Status update on the petition for rulemaking 2nd Update Added 8/19/2019

Just passing along another status update on the rulemaking petition our groups sent to the DCA.  The DCA has referred the matter for further additional deliberations.  Essentially, this is a 90 day extension of time to review.  I take this as a good sign that the DCA is seriously considering adopting at least some of our proposed rulemaking.  Attached is the notice published in today’s register.


Once again I have also attached a copy of the draft resolution we have been asking municipalities to pass in support of the petition.  Please pass this resolution on to any municipalities you have a relationship with.  The support coming from individual municipalities is critical to having corrective measure taken.


Just a small status update on the petition for rulemaking that was submitted in June.  Published in today’s Register (a copy is attached) is a “Notification of Receipt of Petition for Rulemaking.”  This notice does little except confirm that the DCA has received our request.
The DCA still has 60 days to act on our petition – whether that is to publish as rulemaking for public comment, request additional time for review, or to deny the request.  Based on my calculation 60 days from the June 24, 2019 receipt is August 23, 2019.  So, by the end of August we will know what the DCA’s course of action is on our petition.
If you have not done so already, I would ask that you have help spread the word to your municipalities and ask them to pass the Resolution of support that I have drafted.  A copy of this is attached.  I have already received copies from several municipalities that have adopted this resolution.
